Auction Terms & Conditions

1. Legal Contract & Representation

  • Binding Agreement: All successful bidders understand that registration constitutes a legal contract between the buyer and seller.
  • Item Representation: The Periwinkle Auction House and its auctioneers strive to accurately represent the provenance and condition of each item. However, we are not responsible for errors or omissions.
  • Due Diligence: It is the Buyer's duty to view each lot item in person before bidding.

2. Sale Conditions

  • "As Is, Where Is": All items are sold in their current condition and location with no exceptions.
  • Finality: Once an item is sold, the Buyer assumes full risk and responsibility. All sales are final.
  • No Retractions: The Buyer acknowledges that bids cannot be retracted.

3. Auctioneer's Authority

  • Dispute Resolution: In the event of a disputed bid, the Auctioneer has the sole right to determine the successful bidder or to reopen the bidding.
  • Bidding Control: The Auctioneer reserves the right to accept or reject any bid and control the bidding process at all times. The Auctioneer’s decision is final.
  • Lot Removal: The Auctioneer reserves the right to remove any item if a sufficient bid is not received or if a reserve price is not met.

4. Reserves & Absentee Bids

  • Right to Bid: If a reserve exists, the Auctioneer (on behalf of the Seller) or the Seller themselves retains the right to bid.
  • Disclosures: The Auctioneer will disclose the existence of an absentee bid or reserve at the start of a lot (but not the specific amount). After bidding ends, the Auctioneer will indicate if the reserve was met or exceeded.

5. Payment & Fees

  • Buyer’s Premium: A 10% premium is applied to the final hammer price.
  • Taxes: Applicable taxes (15%) will be added to all final purchases.
  • Payment Terms: Full payment is required immediately following the auction close via cash, debit, e-transfer, Visa, or MasterCard. No items may be removed until payment is received in full.

6. Removal & Liability

  • Pickup: The Buyer is responsible for removing all purchases on the day of the auction.
  • Storage Fees: Items paid for but not collected will incur daily moving and storage fees for up to 5 days, after which items will be resold.
  • Liability: The Auctioneer and owner are not responsible for accidents, theft, loss, or damage occurring on the day of the sale.
